Terms and Conditions

Information on how to enter and how to claim prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

To be eligible to enter, individuals must, during the Promotional Period;

1. purchase any LevlUp Gaming Booster, 320g (40 servings) product in one or more of the following flavours, from a participating retail or online-store in Australia or New Zealand;
   1. LevlUp Blue Crush
   2. LevlUp Crazy Monkey
   3. LevlUp Shiny Dragon
   4. LevlUp Shiny Fox
   5. LevlUp Galaxy Edition
   6. LevlUp Nuke Edition
   7. LevlUp Digital Camo (Nutrition Warehouse only)

and;

(b) to enter the Prize Draw, individuals must then visit www.levlup.com/en-au, follow the prompts to the Promotion entry page; and fully complete and submit the online entry form with their personal details including but not limited to first name, last name, email address, mobile number and receipt number.

Entrants must complete and submit an online entry form for each eligible entry. Only one entry per product purchase. For avoidance of doubt, if an entrant purchases three (3) LevlUp Gaming Booster, 320g products in one (1) transaction they may complete up to three (3) online entry forms.

1. Entry is open to all Australian and New Zealand residents aged 18 years or over. Employees (and their immediate families) of the Promoter and its contractors and agencies associated with the promotion are ineligible to enter. “Immediate family” means spouse, parent, grand parent, aunt/uncle, natural or adopted child, sibling (whether natural or adopted by a parent), first cousins, whether or not they live in the same household as the director, manger, employee, officer or contractor.
2. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion.
3. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4. Incomplete, indecipherable or illegible entries will be deemed invalid.
5. Multiple entries are permitted, subject to the following:
   (a) only one entry permitted per specified item and purchase requirement; and
   (b) each entry must be submitted in accordance with entry requirements. Entrants must retain a photocopy of their receipt(s) and order number(s) as proof of receipt as they may be requested to send the original(s) to the Promoter. Failure to produce the proof of receipt for all entries if requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize.
6. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
7. All references to time in this document are a reference to the local time in Sydney, New South Wales, Australia. Promotion commences at 9:00am AEDT on 2 April 2024 and closes at 11:59pm AEST on 31 May 2024(Promotion Period).
8. Prize draw entries must be made via www.levlup.com/en-au and must be received by 11:59pm AEST on 31 May 2024.
9. All claims made for prizes must be received by 11:59pm AEST on 11 August 2024.
10. The sixty-two (62) Prize Draws (60 Daily Draws + 1 Australian Major Draw + 1 x New Zealand Major Draw) will take place at MDSA, Level 16, 1 Denison Street, North Sydney NSW 2060 at 10:00am AEST on 11 June 2024. The first eligible entry drawn in each draw will be the winner.
11. Entries will be entered into the Daily Draw applicable to the day their entry was received by the Promoter. All eligible entries received during the Promotion Period will be entered in the Major Draw according to the entrant’s country of residence i.e. Australia or New Zealand.
12. The drawn winners will be contacted by email within two (2) business days of the draw. The Prize winners will also be published at www.levlup.com/en-au from 18 June 2024, for a minimum of 30 days.

14. Total prize pool value is up to AU$6,199.40 (NZ$6,288.20).
15. Once a claim is received by the Promoter, allow 28 days for receipt of prize.
16. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
17. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
18. A draw for any unclaimed prizes will take place on 18 September 2024 at the same time and place as the original Prize draw/s, subject to any directions from a regulatory authority. Winner/s in an unclaimed prize draw will be notified in writing within two (2) business days of the draw. Winner/s of any prize redrawn will also be notified by phone and published at www.levlup.com/en-au from 25 September 2024, for a minimum of 30 days.
19. For all prize draws the Promoter reserves the right to draw the equivalent number of additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
20. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
21. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
22. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
23. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

27. Printing and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured.
28. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
29. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. The Promoter may, for an indefinite period, unless otherwise advised by the entrant, use the entrant’s personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any opt out, access, update or correct information request to the Promoter. 30. The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
